Below are our terms and conditions for rental of Casa 1 and Casa 2, please ensure you read the following information prior to booking.
 
Terms and conditions of your booking with Casa Kirby

1.       ACCEPTANCE OF BOOKING

Your reservation is legally binding only upon your receipt of our acceptance of booking and not before. If you have any queries or problems they should be raised prior to you receiving our acceptance.

2.       PAYING FOR YOUR HOLIDAY

(a)      Deposits: When you sign a booking form agreeing to these conditions you will be required to pay an initial sum of deposit to us.

(b)      The balance: You must pay the balance shown on the final invoice two calendar months before departure. If payment is not received by the due date, you could be liable for cancellation charges up to 100% of the holiday price, because in this event we reserve the right to treat the booking as cancelled by you at anytime up to the date of departure. IT IS IMPORTANT THEREFORE THAT YOU PAY THE BALANCE BEFORE THE DUE DATE.

(c)      Last minute holidays: Where holiday arrangements are made two months or less before the date of departure, the full invoice sum is to be paid with the booking.

3.       IF YOU CHANGE YOUR HOLIDAY

If after we have issued a confirmation/account and you want to change your Holiday, we will do our best to meet your requirements up to 2 months before departure. If we make the required alterations, e.g. addition of numbers, there will be administration charge. Should there be a reduction in numbers it will result in a loss of deposit. If the alterations are with 56 days of departure cancellation charges will be levied as detailed in section 4 below.

4.       CANCELLATION OF YOUR HOLIDAY

You may be covered by your particular insurance policy for cancellation expenses and costs. You will be liable for the following cancellation fees where written notification is given by you. Between 29 and 56 days prior to departure, 50% of the final holiday charge; 15 to 28 days before 75%; date of departure to 14 days before 100%. NOTE: Only the person who signed the booking form (lead guest) can cancel it and it must be effected in writing.

(a)      In the unlikely event that circumstances beyond our control necessitate cancellation of the holiday arrangements, we reserve the right to cancel any booking at any time and only be liable to refund monies already paid to us.

(b)      If a cancellation or change is bought about by war, Riots, Civil Commotion, Strikes, Disasters, Terrorist Activities, technical problems with transportation or other events outside our control we will not be held responsible in any way.

(c)      All baggage including personal articles, are at all times and under all circumstances at “OWNERS RISK”. No responsibility is accepted for your failure to carry your passports, visas or other documents required for the purpose of your journey.

(d)      All accommodation is booked exclusively for the person(s) named on the booking form. No other person(s) may use the accommodation without our express permission.

(e)      We do not accept liability for the loss of main services i.e. electricity supplies, water supplies, or for the circumstances of actions or omissions of the property management who may control supply of main services, nor any actions taken in the vicinity of the property by any authority over which we have no control.

(f)       In the unlikely event that you wish to complain about any aspect of the accommodation, the complaint should first be conveyed immediately to the managing agents of the property. Should the matter remain unsolved you should convey in writing your complaint to us within 10 days of returning to the UK. If this procedure is not followed, liability will not be accepted.

5.       DESCRIPTION OF HOLIDAY

All information given to you about Lanzarote is provided in good faith. We do not hold ourselves liable in any respect for any shortcomings, claims, matters, obligations, liabilities, injuries or losses arising from the holiday except where and to the extent such arises from proved negligence by us. In some cases of complaint you will of course have the right against third parties, i.e. tour operators, flight companies or your insurance company.

6.       INSURANCE

It is your obligation to take insurance against all and any risks arising from your holiday from the moment you book it.

7.       DAMAGE AND LOSS

Where damage is caused by a holidaymaker to the property or its contents within their control or occupancy, they will be held liable for the damage or loss.

8.       HEALTH CERTIFICATES, VISAS etc.

Various documentation requirements differ from country to country and time to time. You are advised to make your own enquiries and be responsible for ensuring you have all the correct documentation for Lanzarote.
